1. Parties to this agreement

Mjuk Group AB (Business ID: 2988359-9) (“Mjuk”, the “Service”, or the “Online Store”) sells furniture and interior design items (“Product(s)”) to private individuals over the age of 18 and to business customers. Throughout these terms, the buyer is referred to as the “Buyer” or the “Customer”.

2. VAT and Pricing

2.1 The Products sold in the Online Store are subject to the EU margin scheme for second-hand goods, as well as art, collector’s, and antique items. Under this scheme, no deductible VAT is applied (0% deductible VAT).

2.2 An exception applies to Products acquired through corporate partnerships rather than from private individuals. In such cases, the margin scheme does not apply, and VAT is charged according to the applicable rate in the destination country.

2.3 For all EU countries, prices shown in the Online Store include VAT (Value Added Tax). Transport, freight, and storage services are subject to VAT according to the rate of the destination country.

2.4 Products are shipped to the Buyer either from Mjuk’s own warehouse in Finland or directly from partner warehouses. Delivery fees are based on the distance and size/weight of the Product. The final delivery and freight cost is always shown at checkout before the Buyer confirms the order.

2.5 Mjuk reserves the right to modify prices and delivery fees at any time.

3. Product Condition

3.1 All Products sold in the Online Store are quality-checked and condition-rated by Mjuk before being listed for sale. Most of the Products sold by Mjuk are second-hand and are sold "as is".

3.2 Mjuk strives for full transparency, and any signs of wear or imperfections are disclosed to the best of its ability. Each Product is given a condition rating, and any known flaws are shown in the product images and detailed in writing under a separate condition description.

3.3 Condition categories include:

**Brand New/Unused: **Completely unused item, not previously in home use

Excellent: Item in great condition with little to no visible signs of use; minor flaws do not affect the overall appearance

Good: Item in good condition with minor wear from everyday use

Fair: Noticeably worn item with some cosmetic imperfections

Worn: High-quality item that shows significant wear, including visible scratches, dents, or other signs of ageing

4. Product Authenticity

4.1 Mjuk makes every effort to verify the authenticity of each Product based on information provided by the seller or through its expert network. However, Mjuk cannot always guarantee authenticity with absolute certainty.

4.2 If, after the purchase, the Buyer discovers any issue that significantly affects the value of the Product, the Buyer must notify Mjuk in writing by email within four (4) weeks of receiving the Product.

5. Ordering Products

5.1 Orders can only be placed through Mjuk’s official Online Store. An order becomes binding once the Buyer receives an order confirmation by email.

5.2 By placing an order, the Buyer agrees to these Terms of Use. In the event of pricing, calculation, or typographical errors on the Online Store, Mjuk is not obligated to fulfil the order based on incorrect information. Errors will be corrected before the order is processed. In such cases, the Buyer will have the opportunity to confirm or cancel the corrected order.

6. Pricing and Delivery Fees

6.1 Product prices do not include delivery charges. Delivery costs are calculated based on the size of the Product and the delivery address and are shown at checkout before the order is confirmed.

6.2 The selling price of the Product is based on the price at the time of ordering. If promotional discounts are active for similar items at the time of delivery, this does not affect the price of previously purchased Products.

6.3 Discount codes and other offers cannot be applied retroactively. Discounts cannot be combined with other offers and cannot be exchanged for cash.

7. Delivery Terms

7.1 The Buyer must be able to receive the Product within 14 days of ordering unless otherwise agreed.

7.2 In accordance with applicable EU legislation, the Buyer is obligated to cooperate in the completion of the sale. This includes, but is not limited to, providing accurate and complete contact and delivery information, accepting delivery, and taking reasonable steps to enable fulfilment. Failure to meet this obligation may affect the Buyer’s rights under these terms.

7.3 If the Buyer is unable to receive the Product within the above timeframe, Mjuk will charge a storage fee to cover associated costs.

7.4 Storage fees per started week (beginning from the third Monday after the order date):

€35 for large furniture items (pallet-sized)

€20 for medium-sized items (EUR pallet)

€10 for smaller items (under 0.5 m²)

7.5 If the Buyer fails to arrange delivery within a reasonable additional period, Mjuk reserves the right to unilaterally cancel the purchase. In such cases, Mjuk is entitled to compensation for storage costs, which will be deducted from the refund.

7.6 If the Buyer requested delayed delivery, any paid storage fees are non-refundable in case of return.

8. Shipping

8.1 Mjuk ships orders within the EU in cooperation with major international carriers such as DHL, FedEx, and UPS. The delivery partner will contact the Buyer and provide further details. A phone number must be provided at checkout to ensure successful delivery coordination.

8.2 Shipping costs vary based on destination, parcel size, and weight. Final costs are displayed at checkout.

8.3 Delivery times vary depending on the Product’s location and availability.

8.4 Mjuk is not liable for delivery delays or failure to fulfil obligations due to causes beyond its reasonable control, including but not limited to strikes, government actions, supplier failures, or technical disruptions.

8.5 Mjuk may ship items from a single order separately.

8.6 Mjuk accepts liability for loss or damage occurring during shipment.

9. Right of Withdrawal and Returns

9.1 The Buyer has the right to withdraw from an order placed in the Webshop within 14 days, without giving any reason ("cooling-off period"). The period begins on the day the Buyer, or a third party designated by the Buyer other than the carrier, takes possession of the Product. Where Products in one order are delivered separately, the period begins on receipt of the last Product. If the 14th day falls on a Saturday, Sunday, or public holiday, the deadline is extended to the next working day.

9.2 The Buyer may withdraw either through the withdrawal function in the Webshop or by sending a notice to hello@mjuk.com. The withdrawal is timely if the notice is sent within the period. Mjuk will confirm receipt of the withdrawal notice on a durable medium without undue delay.

9.3 After giving notice of withdrawal, the Buyer must return the Product without undue delay and no later than 14 days from the date of the notice, unless Mjuk has agreed to collect the Product.

9.4 The Buyer may handle and inspect the Product only to the extent necessary to establish its nature, characteristics, and functioning, as would be permitted in a shop. The Buyer is liable for any diminished value resulting from handling beyond this, including where the Product has been put into use or, for items delivered assembled or assembled by the Buyer, damaged through disassembly or repacking. Mjuk may deduct an amount corresponding to the diminished value from the refund. Mjuk asks that items requiring assembly be returned disassembled and packed in the original or equivalent packaging; the absence of original packaging does not by itself prevent the return but may be taken into account in assessing diminished value.

10. Return Shipping and Refunds

10.1 If the Buyer withdraws, the Buyer bears the direct cost of returning the Product, unless the Product is defective or Mjuk has agreed to bear the cost. This also applies where the Buyer asks Mjuk to arrange collection (see clause 10.9).

10.2 Some Products sold by Mjuk are second-hand or outlet items and may show visible signs of wear. Where such signs are described and shown in the product listing, the Product may still be returned, but at the Buyer's own expense. Such returns are not treated as complaints, and Mjuk does not cover shipping costs in these cases.

10.3 Mjuk refunds the amount paid using the same payment method the Buyer used, unless the Buyer has expressly agreed to an alternative.

10.4 Mjuk refunds the purchase price and delivery costs without undue delay and no later than 14 days after being informed of the Buyer's decision to withdraw. Of the delivery costs, Mjuk refunds up to the cost of the least expensive standard delivery method it offers; any supplementary cost arising from a more expensive delivery method chosen by the Buyer is not refunded.

10.5 Mjuk may withhold the refund until it has received the Product back or the Buyer has provided proof that the Product has been dispatched.

10.6 The Buyer incurs no charge for the reimbursement transaction itself.

10.7 If the Product's price has changed since the order, the Buyer is refunded the original amount paid.

10.8 The right of withdrawal applies to consumers. Purchases made by businesses or institutions are not covered by this right.

10.9 If the Buyer asks Mjuk to arrange collection of a withdrawn Product, the collection is carried out at the Buyer's expense as part of the return. Mjuk covers the cost of collection using the delivery charge paid by the Buyer, and the delivery charge is not separately refunded in that case.

10.10 If the Buyer returns only part of an order and keeps the other Products, the delivery charge is not refunded, as it was incurred for delivering the Products the Buyer keeps.

11. Complaints

11.1 Complaints regarding faulty or damaged Products must be submitted within three (3) days of receipt by email to hello@mjuk.com.

11.2 Mjuk is not liable for defects resulting from misuse or negligence by the Buyer.

12. Warranty

12.1 Mjuk offers a maximum warranty period of one (1) year for its furniture, corresponding to the minimum required under EU law, provided that the Buyer has explicitly agreed to this limitation.

12.2 By placing an order on Mjuk’s website, the Buyer accepts this warranty condition.

13. Additional Terms

13.1 All content provided by the Service including images, graphics, and text is protected by copyright and other applicable intellectual property laws.

13.2 Your personal data is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (EU 2016/679, "GDPR"). For more information on how Mjuk collects, processes, and protects your personal data, please refer to our Privacy Policy.
